1. Description of Services

DartFrog Books is an award-winning hybrid publisher providing manuscript evaluation, editorial services, book design, distribution, and book marketing services for independent authors. We do not accept all manuscript submissions; we operate several curated imprints requiring authors to meet our editorial standards.

Specific deliverables, timelines, and financial obligations for our publishing and marketing
packages will be outlined in a separate written Publishing Agreement signed between the
Author and DartFrog Books. In the event of a conflict between these Terms of Service and a
signed Publishing Agreement, the Publishing Agreement shall govern.

2. Intellectual Property & Author Rights

2.1 Author Rights: DartFrog Books publishes books through our traditional imprint (DF Blue) and our hybrid imprints (DF Hybrid, DF Kids, Open Table Press, Authority Book Lab). We also provide production support for self-publishing authors (Canoe Tree Press). We do not own your copyright, and we do not claim unwarranted rights.

You retain 100% of the copyright to your manuscript and published book. DartFrog does not claim ownership over your intellectual property. You grant us only the necessary non-exclusive licenses to format, distribute, market, and sell your work as outlined in your specific Publishing Agreement.

2.2 DartFrog Intellectual Property: The Site and its original content (excluding author manuscripts), features, functionality, logos, design templates, and the True OriginTM seal are owned by DartFrog Books and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

3. True OriginTM Certification

True Origin™ does not certify that a manuscript was created without the use of artificial intelligence. Rather, it documents the author’s creative development process by preserving timestamped records associated with manuscript files and other submitted materials over time.

A True Origin certification reflects the documentation provided by the author throughout the development of the work. If DartFrog later determines that certification was obtained through materially false, misleading, or intentionally deceptive information or documentation, True Origin reserves the right to revoke the certification.

4. User Accounts and Responsibilities

To use certain features of our Services, you may be required to provide accurate, current, and
complete contact information. You are responsible for:

-Maintaining the confidentiality of any account credentials.
-All activities that occur under your account.
-Ensuring that any manuscript or materials submitted do not violate the intellectual property
rights, privacy rights, or publicity rights of any third party.
-Ensuring your submissions do not contain defamatory, libelous, or unlawful material.

5. Payments, Fees, and Refunds

5.1 Fees: Hybrid publishing and marketing require a co-investment from the author. All fees, payment schedules, and exact services rendered will be clearly detailed in your specific
Publishing Agreement before any work begins.

5.2 Refunds: Because our services involve immediate labor (editorial review, design, strategy),
all fees paid are generally non-refundable once work has commenced. Specific termination and refund clauses related to the publishing process are detailed in your individual Publishing
Agreement.

6. Limitation of Liability

To the fullest extent permitted by applicable law (including US federal and state law, and EU
consumer protection laws where applicable), DartFrog Books, its affiliates, directors, employees,
or agents shall not be liable for any indirect, incidental, special, consequential, or punitive
damages, including without limitation, loss of profits, data, use, goodwill, or other intangible
losses, resulting from:

-Your access to or use of or inability to access or use the Services.
-Any conduct or content of any third party on the Services.
-Any errors or omissions in editorial or design work, once final proofs have been approved by
the author.
-The commercial success or sales volume of any published book. DartFrog Books makes no
guarantees regarding the number of books sold.

7. Disclaimers and Warranties

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS
AVAILABLE” basis. DartFrog Books expressly disclaims all warranties of any kind, whether
express or implied, including, but not limited to, implied warranties of merchantability, fitness for
a particular purpose, and non-infringement.

We do not warrant that (a) the Services will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; or (c) the results of using the Services will meet your specific sales or marketing expectations.

8. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the United States,
without regard to its conflict of law provisions.

For users accessing the Site from the European Union, these Terms shall not deprive you of the protection afforded to you by provisions that cannot be derogated from by agreement by virtue of the law of the Member State where you have your habitual residence.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a
revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to
access or use our Services after any revisions become effective, you agree to be bound by the
revised terms.
